Head of Household & Form 8332

Head of Household and Form 8332 cover different tax rules. Learn the general filing-status tests, what a custodial parent may release, and which benefits Form 8332 does not transfer.

What are the general Head of Household tests?

To file as Head of Household, you generally must be unmarried or considered unmarried at year end, pay more than half the cost of keeping up a home, and have a qualifying person under the IRS rules. A child generally must live with you for more than half the year to qualify you under the child-related household test. Special rules can apply, including for a qualifying parent.

The cost of keeping up a home includes eligible household costs such as rent, property tax, mortgage interest, utilities, repairs, insurance, and food consumed in the home. Costs such as clothing, education, medical care, vacations, and life insurance are generally not included in this household-cost test.

What does Form 8332 do?

Form 8332 is used by a custodial parent to release or revoke a release of a claim for a child for certain dependency-related tax benefits. A noncustodial parent generally needs the signed release and must meet the other applicable rules to claim the benefits covered by the release.

Form 8332 does not transfer Head of Household filing status, the Earned Income Credit, or the Child and Dependent Care Credit. Those benefits have separate rules. Child support paid or received, by itself, does not decide filing status or who may claim a child for federal tax purposes.

Check each benefit separately. Filing status, dependency claims, the Child Tax Credit, Earned Income Credit, and child-care benefits do not all follow the same rules. The IRS publications and the facts for the tax year matter.
